The terms “we” “our”, “us”, “ICF”, “InstantCarFix” and “Instant Car Fix” refer to Instant Car Fix LLC, its subsidiaries and its affiliates, and the terms “you” or “your” refer to any individuals who access this Website. By accessing or using this Website, you agree and consent to be legally bound by these Terms and Conditions of Use (the “Terms”) and Privacy Policy without limitation or qualification. Failure to comply with the Terms may lead to legal action and ICF has the legal right to claim for damages.

Eligibility

Your use of the Site constitutes your acceptance of the Terms. By accepting the Terms through your use of the Site, you certify that you are either (i) 18 years of age or older or (ii) you are at least 13 years of age and are using the Site under the supervision of a parent or legal guardian who has agreed to be bound by these Terms on your behalf. If you are under the age of 13, you are not permitted to use the Site. If you are a parent or legal guardian who has agreed to be bound by these Terms on behalf of a child between the ages of 13 and 18, you agree to be fully responsible for such child's use of the Site, including all financial charges and legal liability that such child may incur.

Changes to the Terms

You agree that Instant Car Fix may change, modify, terminate, add, delete or reword including without limitation, these Terms and any applicable Privacy Policy at any time without advance notice to you. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Your Account

You are solely responsible for maintaining the confidentiality of your login credentials, including username and password, at all times. Instant Car Fix will not be liable for any loss or damage from your failure to comply with this security obligation. You are also responsible for all activities that occur under your account. If you believe your credentials have been compromised, please contact us immediately. You agree to maintain accurate, complete, and up-to-date information in your account. Your failure to maintain accurate, complete, and up-to-date account information may result in your inability to access and use the services on ICF platform.

Non-Solicitation

You agree not to solicit or engage any mechanic introduced by ICF for your own benefit, or introduce the mechanic to any third party, outside of the ICF platform from the day a mechanic was introduced to you and for two years thereafter. If you breach these terms, you agree that you shall reimburse ICF for actual damages arising from the lost revenue of ICF and liquidated damages related to an uncertain breach of the non-solicitation clause herein.

Authorization

By agreeing to the Terms, you are giving us permission to charge your on-file debit card, credit card, Paypal account or any other approved methods of payment for fees that you authorize for. Instant Car Fix uses third-party intermediaries to manage credit card processing. The payment processing intermediaries may store, retain, or use credit card and other billing information to process orders in connection with the Instant Car Fix platform. ICF will make reasonable efforts to maintain the confidentiality of all credit card and any payment information that is submitted by you and/or processed via the ICF platform. However, we cannot control the actions of third-party intermediaries, and we cannot guard against or prevent all possible breaches of our systems by third parties who may attempt to gain access to the platform through unauthorized and/or illegal methods. ICF shall not be liable to any customer or any third party for any loss, damage, misuse, or unauthorized access of any information contained in or related to any customer’s Account, including credit card information and personal information relating to their clients.

Parking Fee Responsibility

In the event that the service necessitates performing work at a parking garage or parking lot, the customer shall assume responsibility for covering the parking expenses incurred by our technician during the service duration.

Payments to Mechanics

Payments made directly to the technician outside of ICF platform would be considered a voluntary arrangement between the customer and the technician. Instant Car Fix does not exercise any control over or involvement in payments made outside of our platform. In such cases, these payments are akin to tips or gratuities that customers sometimes choose to offer as a token of appreciation.

Responsibility of Payment

You are responsible for all fees, including any applicable federal, state or local taxes. When you use the service, you will have to provide us with a valid means of payment. You agree to pay Instant Car Fix any charges incurred in connection with your use of the service. Charges paid by you are final and non-refundable, unless otherwise determined by ICF. We reserve the right to establish, remove and or revise Charges for any or all Vehicle Services at any time in our sole discretion. If a Technician changes the Vehicle Services needed, or adds additional Vehicle Services, you authorize the payment of updated or modified Charges. If the Technician determines that your car requires services other than the Vehicle Services you specified in your original Job Request or that the Technician is not able to perform such work, you may be charged a separate diagnosis fee. If the Technician determines that the claimed defect is not the result of a defect in materials or workmanship of the Vehicle Services, you will be charged for one hour of labor fees of $99.99.

In an event that our mechanic performs a diagnostic assessment on your vehicle, and upon inspection, he is unable to replicate or identify the reported issue as defined in the orignial work order, a service fee will be changed for the time and expertise expended during the diagnosis. This fee is non-negotiable and will be billed at our standard diagnostic rate.

Access

You agree that you must make yourself available to hand over your vehicle to the technician. Also, it is your responsibility to provide a suitable location to complete the job. You agree to treat technicians respectfully and lawfully and to provide reasonable cooperation to them to enable them to inspect, conduct video and/or photo recording of your vehicle, receive your vehicle, complete the job and return your vehicle to you.

Delay

Instant Car Fix will not be responsible for delays in repairing from events arising beyond its control. Furthermore, we do not guarantee timelines for completion of a job request. You acknowledge and agree that job requests may take longer to complete than the estimated timelines communicated to you through the ICF platform and that ICF shall not be held liable or responsible for any delay in completion of a job request. Due to any unforeseen circumstances, if our technician is running late, the mechanic may attempt to contact you and inform the new estimated time of arrival.

Vetting of Technicians

Technicians may be subject to a vetting process before they can register for and during their use of the ICF Platform, including but not limited to criminal history, credit history, eviction records and motor vehicle records, Although we may perform checks of technicians, we cannot and do not assume any responsibility for the accuracy or reliability of technical expertise, identity or any other information provided to us by the technician. Customers are encouraged to exercise caution for your own safety while interacting with technicians.

Certified Mechanic Clause

The term "certified mechanic" used in our policies does not exclusively refer to ASE (Automotive Service Excellence) certification. While ASE certification is widely recognized in the automotive industry, our definition of a certified mechanic encompasses individuals with equivalent certifications or extensive experience and expertise in automotive repair.

Order Cancellation, No-show, Reschedule and Refunds, Work Cancellation

Cancellations made more than 24 hours in advance of the service start time will receive a 100% refund. Cancellations made less than 24 hours of the scheduled service start time will incur a $99.99 cancellation fee. Please note that if the same day service fee is paid, it is completely non-refundable. This ensures that our commitment to providing prompt, prioritized service is maintained.

If you fail to make yourself available to the mechanic on the date and time of the appointment, you will incur a $99.99 no show fee. If the customer does not show up for their scheduled appointment, the mechanic will wait for 15 minutes. After this waiting period, if the customer has not arrived or notified us of their delay, a no-show fee will be charged.

If you wish to reschedule the appointment, you will be charged $24.99 reschedule fee if the request is made less than 24 hours of the scheduled service start time. You could reschedule the appointment at no cost if the request is made more than 24 hours in advance of the service start time.

Refunds will be done only through the Original Mode of Payment. In the event, transaction error has occurred while making the payment, a refund in most cases will be issued to the same method of payment you used for the original purchase. When a technician cancels a scheduled job, we generally notify you and make reasonable efforts to find another technician for you. However, there is no guarantee that another technician will be found for the service requested and job be completed. You hereby agree to hold us harmless from any liability that may result from the cancellation of a job or our inability to find another technician for the service requested on the scheduled date.

If the customer requests to halt the work after it has began, the customer will be responsible for the payment of full contract amount, as specified in the original order agreement. This includes any work completed upto the point of cancellation, as well as costs incured for resources and efforts invested in the project.

Disputes Over Amount and Legal Action

If the customer disputes the amount charged for services rendered and the credit card company or payment platform decides to grant the decision in favor of the customer, then Instant Car Fix reserves the right to pursue collections to recover the outstanding amount. If the amount remains unpaid after reasonable attempts for collections, Instant Car Fix reserves the right to file a lawsuit to collect the amount due. In such cases, the customer would be responsible for attorney and court fees incurred by Instant Car Fix. Attorney fees may vary depending on the complexity of the case and the duration of legal proceedings but are estimated to range between $500 to $10,000.

In the event of a dispute filed by the customer, Instant Car Fix reserves the right to collect fees for the time spent in preparing the case, including but not limited to administrative costs, legal fees, and any other expenses incurred.

Once a dispute is filed with a credit card company, any subsequent claims made with our company will not be considered. It is crucial to understand that responding to a dispute involves providing detailed documentation and evidence to the credit card company, which requires substantial resources. Therefore, we strongly advise customers to contact Instant Car Fix directly before pursuing a dispute to ensure a smoother resolution process.

In the event of any dispute arising from services provided by Instant Car Fix, both parties agree to resolve the matter through arbitration conducted in-house. This arbitration agreement prohibits the involvement of any outside parties or third-party arbitration services. The decision reached through arbitration shall be final and binding on both parties.

If there is a dispute, the customer can contact us via email at claims@instantcarfix.com for resolution. By engaging in this arbitration process, the customer agrees not to pursue legal action or sue Instant Car Fix in any court or jurisdiction.

Diagnostic Fee Policy and Claims for Past Services

Diagnostic Fee: A diagnostic fee will be charged for all diagnostic services provided by Instant Car Fix, covering the time and expertise of our specialized mechanics in conducting thorough assessments, regardless of customer agreement or satisfaction with the diagnosis.

Claims for Past Services: In the event of a claim related to a service performed in the past, the customer must arrange for a diagnostic appointment with our mechanic to confirm the findings. If the issue is determined to be directly related to the work previously done by Instant Car Fix, no diagnostic fee will be applied.

New Issues: If the issue identified during the diagnostic appointment is determined to be unrelated to the previous work done by Instant Car Fix, a diagnostic fee will be applied as per our standard policy.

We are committed to addressing customer concerns promptly and providing transparent service experiences.

Incorrect Parts Ordered by Customer

In cases where the customer provides incorrect or incompatible parts for a labor-only service, our company reserves the right to charge the customer the full amount as described in the original work order to cover the technician's time spent evaluating, diagnosing, and addressing the issue.

Limited Warranty

This Limited Warranty, which is provided by Instant Car Fix LLC, in only applicable to the original purchaser of Vehicle Services that was requested and scheduled through the ICF platform and does not extend to any person who may purchase your car after the Vehicles services are performed. Pre-Purchase Car Inspection

For the most reliable inspection results, it is essential that a vehicle be clean and dry to ensure proper visibility of all its components. Additionally, ample lighting is also critical for a Technician to accurately detect any indications of prior bodywork or repainting as these tasks are not conducted by technicians during pre-purchase inspections. Poor weather conditions and uncleanliness can significantly impede an accurate examination so make sure your car meets these criteria before proceeding with the inspection process!

A technician will travel to your location in order to assess the car, but they won't be lifting it up - only using a floor jack on certain parts. Pre-purchase inspections aren't meant for diagnosing problems; typically no diagnostic equipment is used during these tests. The technician may note down the vehicle identification number (VIN), though this doesn't involve establishing its authenticity or verifying any history/title information connected with it.

Although pre-purchase inspection reports are not guaranteed or warranted, it's important to note that cars can undergo changes and/or develop issues from the time they're inspected to when they're purchased. During these inspections, our technicians cannot see inside an engine or transmission nor do we take apart every component of a car - this means any potential malfunctions may not be apparent at the moment of examination.

Although our Technicians may make comments, it is ultimately up to you whether or not you purchase a vehicle. Be aware that we are in no way responsible for advising on the value of any vehicle, authenticating its origin, determining if a vehicle is emission compliant, or ensuring that the car will perform properly. All decisions and consequences pertaining to your purchase must be assumed by yourself alone.

If a customer cancels the pre-purchase inspection midway due to the car being damaged, the customer will still be charged the full amount specified in the original work order.

If the mechanic goes for a pre-purchase car inspection and finds out that the car is already sold, Instant Car Fix will charge the full amount for the service as stated in the original work order.

Body Work Repairs

Body work services provided by ICF may not restore your vehicle to its original state a 100 percent. There may be minor variations in color, texture and alignment. While we strive to match paint colors accurately, variations may occur between the old and new paint, even when paint is matched.

Paint Matching Disclaimer: While every effort will be made to accurately match paint colors to the vehicle's original finish, the company cannot guarantee an exact color match due to variations in paint formulas, aging of the vehicle's existing paint, and other factors beyond its control.

Utilization of Canned Sprays: It is hereby affirmed that canned sprays are employed for body work purposes. The company utilizes canned sprays exclusively for the application of paint during the body work process.

Customer Acknowledgment of Risk: By agreeing to the terms, customers acknowledge the inherent risks associated with automotive body repairs, including the possibility of unforeseen issues arising during the repair process.

Indemnification: Customers agree to indemnify and hold the company harmless against any claims, damages, or liabilities arising from their use of the company's services, including but not limited to claims by third parties for property damage or personal injury.

Disclaimer of Warranty: The company provides body work repairs "as is" and makes no warranties, express or implied, regarding the quality, durability, or fitness for a particular purpose of the repairs performed.

Termination

You can stop using the service at any time without notice to us. ICF has the right to suspend or terminate your access to all or any part of the website at any time, with or without cause or notice, effective immediately. ICF reserves the right to refuse service to anyone for any reason at any time.

Diagnosis

When you schedule a diagnosis job with Instant Car Fix, the mechanic would go through a step-by-step process of ruling out or confirm the parts that have failed. This could be done through visual inspection or through running various tests. For each diagnostic service call, our mechanic will diagnose one specific issue as reported by you or as evident by the inspection. Should the car experience multiple issues, we recommend scheduling separate service calls to address them effectively. Although mechanics use their expertise in performing diagnosis, we cannot guarantee that any particular diagnosis will identify all of the problems with the car (and/or solutions) during the first inspection. Any subsequent or follow up inspection will be charged a separate diagnosis fee. For e.g., if the car has died due to the battery and alternator failing at the same time, the mechanic would not be able to check the alternator if battery has failed. He would recommend replacing the battery as the first step. If the car would not start even after replacing the battery, the mechanic would have to come for a diagnosis again and the customer would be charged a separate diagnosis fee.

After receiving a diagnosis, you may or may not request subsequent repair work recommended based on the diagnosis of the technician. You agree that our Limited Warranty applies only to such repair work, not to the completeness of the diagnosis or to any problems that you may be experiencing with your car (other than a problem with the replaced part itself). For example, if your car has a coolant leak, the leak may be coming from different places in your engine. The Technician may recommend replacing the part responsible for the most obvious source of the leak, and then recheck the car to see if there are other components that are leaking too. You understand that, if there are other leaking components, replacing those other components would be separate work subject to an additional Charge. For e.g., if the technician spots a hose leaking coolant, he would recommend replacing those. However, after replacing those and doing a pressure test, he finds that water pump is leaking coolant too, those would be considered separate work and be subject to an additional charge.

Law

To the extent permitted by applicable law, these Terms will be governed by the laws of the State of Virginia for residents of the United States.

Any disputes arising out of or relating to this contract shall be exclusively governed by and construed in accordance with the laws of the state of Virginia, without regard to its conflict of law principles. The parties hereby consent to the exclusive jurisdiction of the courts located in Virginia for any legal proceedings or actions arising out of or related to this agreement.

Electronic Communications

Visiting this Website, texting, calling, chatting, contacting us on social media or sending emails to us constitutes electronic communications. You consent to receive electronic communications from us and agree to notify us of any changes in your telephone number or email address, either by calling or emailing us or updating your account profile on the website. Except as otherwise required under applicable law, you agree that all agreements, notices, and other communications that we provide to you electronically, via email, text or on the Website, satisfy any legal requirement that such communications be in writing.

You authorize us to contact you, including by sending text messages directly or through a conduit text messaging service and other communications to a cell phone using an automatic telephone dialing system or an artificial or prerecorded voice message, at any number you provide. You acknowledge that any text messages or prerecorded messages sent by us may contain sales or marketing content. You may revoke your consent for us to contact you at a specified telephone number by communicating your revocation to us through any reasonable means. Depending on your mobile carrier, you may be charged for the text messages received from ICF.

Understanding General Diagnosis: Clarification of Service Scope

When a customer selects general diagnosis on our website, it does not imply that the mechanic is obligated to check for all issues in the vehicle. The general diagnosis service is intended to identify common problems or initial symptoms, and further diagnostic steps may be necessary based on the findings.

Electrical Diagnosis Policy and Costs

At Instant Car Fix, we have specific policies regarding electrical diagnosis and associated costs. When a customer selects a diagnosis other than electrical diagnosis and our mechanic identifies an electrical issue during the diagnosis, the customer will be charged for one hour of labor, which is the standard charge for diagnosis. Our team will inform the customer if electrical diagnosis is needed during a diagnosis other than electrical diagnosis, giving them the option to pay extra for this service. If the customer decides against the electrical diagnosis, they will still incur a one-hour diagnosis charge.

It's important to note that not all mechanics at Instant Car Fix are equipped to perform electrical diagnosis. If our company needs to dispatch an electrician specifically for diagnosing electrical issues, there will be an additional cost incurred.

Additionally, it's worth mentioning that just because a mechanic identifies an electrical issue during a diagnosis, this still warrants a diagnosis fee. Electrical diagnostics are often time-intensive and may require more than one hour, for which customers will be billed on an hourly basis.

Understanding Our Estimate Process: Timelines and Terms Explained

Instant Car Fix strives to provide estimates promptly, but in some cases where parts are challenging to locate, it may take up to a week to finalize the estimate. Please note that providing estimates is not obligatory after a diagnosis. Diagnosis is considered a separate service, and we are not obligated to proceed with repairs unless mutually agreed upon. We are not required to furnish a written report for the diagnosis. The diagnosis can be conveyed verbally, in writing, or through communication by the mechanic.

Ownership

All materials on our website are owned or licensed for use by Instant Car Fix LLC and are protected by intellectual property rights, including copyright and trademark laws. Use of any and all content on the website, including but not limited to text, images, graphics, designs, and logos, is only allowed for personal informational viewing purposes, and any distribution, reproduction, or duplication (regardless of means of distribution) of website content is strictly prohibited unless you have received our prior written approval. Any modification or use of the content of our website, other than as expressly provided for within this Terms of Use violates our intellectual property rights.

Limitation of Liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

We reserve the right to cancel any order at our discretion and without prior notice. Circumstances leading to cancellation may include, but are not limited to, stock availability, pricing errors, suspicion of fraudulent activity, or any other unforeseen circumstances. In the event of order cancellation, customers will be promptly notified, and any payments made towards the canceled order will be refunded.

In no case shall ICF, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, loss of wages, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. We expressly reserve the right, at our sole and complete discretion and at our own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with us in asserting any available defenses.

Authorization for Additional Work

Customers must obtain explicit written authorization for any additional work beyond the scope of the original work order. This authorization must be obtained from Instant Car Fix before the commencement of such work. Failure to obtain authorization for additional work constitutes a breach of contract.

Instant Car Fix shall not be liable for any damages, direct or indirect, arising from a breach of contract by the customer. This includes, but is not limited to, any costs incurred by the customer for unauthorized work performed by the mechanic. Instant Car Fix reserves the right to pursue legal action against the customer for breach of contract.

Supplementary Service Policy

If a customer has signed up for a specific service and during the course of the service, our mechanic determines that additional supplementary work is required and the customer elects to proceed with such work on the same day, an inspection or diagnostic fee may be applied. This fee is intended to compensate for the time spent on the road and the disruption to our schedule, particularly in cases where the warehouse is located at a significant distance from the service location.

Services

You agree that no joint venture, partnership, employment, or agency relationship exists between you and us as a result of these Terms or use of the Website.

www.instantcarfix.com is a service provider website that connects users to a network of independent third party vehicle service providers (herein called as “mechanics”, “technicians” or “independent contractors”) to perform vehicle inspection, diagnosis, maintenance, repair or related services (“Vehicle Services”).

A Mechanic provides vehicle services to you as an independent contractor, and there is no employee, joint venture, partner, agent, or franchisee relationship for any purpose whatsoever. You acknowledge that services are provided by third party independent contractors who are not employed by Instant Car Fix. You acknowledge that Instant Car Fix does not supervise, direct or control the performance of services provided by independent contractors for you or for your benefit.

Same Day Service Policy

Our same day service is designed to prioritize your urgent needs. While we aim to complete all same day services on schedule, there may be occasional delays. Rest assured, if you've paid for same day service and our mechanic begins work on your vehicle as scheduled, the same day service fee applies regardless of completion time.

We communicate any delays promptly and aim for transparent, reliable service to ensure your satisfaction.

Flat Tire Repair Policy

In situations where the mechanic is unable to locate the source of the air leak or the tire is deemed unpatchable during flat tire repair service, the customer will still be charged the amount specified in the original work order. This charge covers the time and effort spent by our mechanic in attempting to locate the leak and assess the tire's repairability.

Cancellation Policy for Incorrect or Incomplete Addresses

If a customer provides an incorrect or incomplete address resulting in the inability to render services, Instant Car Fix reserves the right to cancel the appointment. In such cases, a no-show fee will be charged.

Limited Liability Clause for Diagnosis Done By Third Parties

Upon engaging Instant Car Fix's services subsequent to an external diagnosis by another mechanic, not affiliated with Instant Car Fix, the customer acknowledges and agrees to the following:

Instant Car Fix shall not be held liable or responsible for any issues arising during or after the service, specifically those stemming from preexisting conditions not identified in the initial external diagnosis. The mechanic from Instant Car Fix is not required to crank the car to check its functionality or diagnose additional issues before starting the work as defined in the work order. In the event that the car does not start after the repair, Instant Car Fix is exempt from any liability or responsibility.

By proceeding with Instant Car Fix's services following an external diagnosis, the customer explicitly absolves Instant Car Fix from any claims, damages, or liabilities resulting from preexisting conditions or issues beyond the scope of the diagnosed problem.

Incorrect Services Selected

In the event that a customer orders or selects services that are deemed incorrect for their needs or specifications, the full service amount will be forfeited. It is the responsibility of the customer to ensure the accuracy of their service selection prior to confirmation and payment. Refunds or credits will not be issued in cases where services have been mistakenly ordered or selected by the customer.

Claims Processing Policy

All claims must be submitted directly to our Claims Department for review and processing. If a new work order is submitted instead of filing a claim, the claim will be automatically denied, and the request will be treated as a new work order, subject to standard service fees.

To ensure your claim is processed correctly, please follow the guidelines provided by our Claims Department. Failure to do so may result in delays or denial of your claim.

Service Declination

If a customer declines the service after the mechanic has arrived at the location, the customer will be charged the full amount for the service. This policy covers the mechanic's time, travel expenses, and any preparatory work done prior to arrival.

Restocking Fee

If a customer orders the wrong service, there will be a 20% restocking fee for the parts that need to be returned to the store.

Example: If a customer requests a starter replacement, but the mechanic diagnoses that the starter is not the issue and a replacement is unnecessary, the parts that were initially ordered for the service will have to be returned to the warehouse. In this case, a restocking fee of 20% of the total amount paid for the parts by the customer will be applied. This fee covers the costs associated with returning the parts to the supplier and restocking them.

Partial Service Order Policy: Compensation for Unperformed Services

When a customer engages Instant Car Fix for multiple automotive services, such as brake replacement, oil change, and tire rotation, and decides to proceed with only the brake replacement while opting out of the oil change and tire rotation, the customer shall not be eligible for credit or reimbursement for the unperformed services. For instance, if the customer initially requested all three services but later decides to proceed with only the brake replacement, Instant Car Fix will not provide credit for the omitted oil change and tire rotation. This policy is in place because the mechanic invests time and effort in sourcing necessary parts and planning for the complete scope of requested services, and thus deserves compensation for these preparations, even if some services are not ultimately performed.

Labor Only Services Selected

If the customer chooses to obtain a diagnosis from a third-party mechanic and subsequently engages Instant Car Fix for repair services based on that diagnosis, Instant Car Fix shall be solely responsible for performing the repairs outlined and agreed upon by the customer.

In the event that the third-party diagnosis proves to be inaccurate, incomplete, or misses certain points, Instant Car Fix shall not be held responsible for any discrepancies or issues arising from the accuracy or completeness of the third-party diagnosis. The customer acknowledges that the responsibility for the accuracy and thoroughness of the diagnosis lies with the third-party mechanic, and Instant Car Fix shall not be liable for any consequences resulting from a misdiagnosis or incomplete assessment.

By engaging Instant Car Fix for repair services based on a third-party diagnosis, the customer accepts and understands that any discrepancies in the diagnosis are beyond the control and responsibility of Instant Car Fix, and the scope of the repair services shall be limited to the points explicitly outlined by Instant Car Fix.

By opting for labor only services with customer supplied parts you acknowledge and agree that you will be responsible for providing all necessary parts and suplemental materials required for the service. It is the customers responsibility to ensure that the provided parts are compatible, safe and of the correct specifications for the intented service. In an event that customer supplied parts are incorrect, incompatible, or unsafe for the intended service, the customer is still obligated to pay for the labor as defined in the original work order. The labor charges are separate from the cost of parts and remain due.

Please note that it is the customer's responsibility to provide all necessary parts required for labor-only services. For example, if a water pump replacement necessitates the removal of the intake manifold, it is incumbent upon the customer to supply the intake manifold gasket. In the event that the customer fails to provide the required parts, our mechanic will utilize the existing gaskets. Instant Car Fix shall not be held responsible for any damages or complications arising from the use of existing gaskets or parts due to the customer's failure to provide necessary components for labor-only services.

Limited Use and Access

This site is controlled, operated and administered by us from offices within the United States of America and for the purpose of servicing our customers and promoting the products and services that we offer. We make no representation that these products and services or the materials at this site are appropriate or available in all states.

Enforceability

These Terms shall be given effect to the fullest extent permissible by law. If any provision of these Terms is deemed unlawful, void, or unenforceable for any reason whatsoever, that provision shall be severed and the rest of these Terms shall remain valid and in full force and effect, and a provision as similar in terms as may be valid and enforceable shall be used in lieu of such provision. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Entire Agreement and Headings

These Terms and Conditions coupled with the Privacy Policy, reflect the entire agreement between you and us regarding the Website and supersede and replace all prior or contemporaneous understandings or agreements of any type regarding this subject matter. Notwithstanding the foregoing, any additional terms and conditions provided with any service or product you obtain through the Website will also govern your use of that service or product. The headings used herein are provided solely for your convenience and have no legal or contractual effect. A printed version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to the Website to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that these Terms and all related documents be written in English.

Assignment

You may not assign any of your rights, licenses, or obligations under these Terms. Any such attempt at assignment by you shall be void. ICF may assign its rights, licenses, and obligations under these Terms without limitation.
